A Federal High Court
in Port Harcourt has sentenced a middle-aged man, Sunday Okeke, to eleven years imprisonment for producing fake and adulterated NAFDAC regulated alcoholic beverages.
The offence is in contravention of Section I of Drugs and Regulated Products (Registration) of 1993 as amended and punishable under section 6 (1) of the same Act as well as Section I (a) of counterfeit and fake drug and unwholesome processed foods (miscellaneous provisions)  Act of 1999 and punishable under section 3 of the same Act.
The presiding Judge, Justice R.M Aikawa, found the accused guilty of all four count charges proffered against him by the prosecuting counsel Mohammed Bello Esg. Head of Legal Division of the Agency.
The convict, Mr Sunday Okeke, who lives at No B.O 4 Rumuomasi Mammy Market Nigerian Airforce Port Harcourt, was dragged before the court for illegally manufacturing labeled and packaged unwholesome drinks; Baccks Tonic Wine, King Edward Centurion and Glen Gary old Blended Scotch, without batch number.
In his judgment, Justice Aikawa said that the prosecution has proved his case beyond all reasonable doubts noting that the accused actually committee the offence as averred by the prosecuting counsel and convicted accordingly on all the four count charges. Counsel to the accused Chinwike Izuehie, however, pleaded with the court  for the conviction attributing it to diligent prosecution adding that the agency has sent a bill to the National Assembly to make penalties on counterfeiting more stringent.
